SCI has submitted a response to the NLRB Proposed Rule: The Standard for Determining Joint-Employer Status. The ambiguity of the Proposed Rule and the unprecedented use of the reserved control factor will harm independent contractors and third-party administrators. The Board is proposing to rescind the 2020 Rule before it has ever had a chance to operate and replace it with a joint-employer standard that will severely limit independent contractors in the business sector.
